VendorWheel (“VendorWheel,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit or use VendorWheel.com and VendorWheel’s marketplace, community, listings, accounts, communications features, and related services (collectively, the “Platform”).
VendorWheel is a community and marketplace platform designed to help participants in the mobile food industry discover and connect with one another.
By using the Platform, you acknowledge the practices described in this Privacy Policy.
1. Information We Collect
The information we collect depends on how you interact with VendorWheel.
Information You Provide to Us
You may provide information when you:
- create an account;
- claim a business or other listing;
- create or update a listing;
- post an opportunity;
- submit a review or other content;
- contact another user;
- contact VendorWheel;
- request verification;
- purchase a VendorWheel-provided service; or
- otherwise interact with the Platform.
Information you provide may include your:
- name;
- email address;
- telephone number;
- account credentials;
- business or organization name;
- business contact information;
- business address, location, or service area;
- website and social media information;
- photographs and other listing content;
- food truck, Wheel Spot, commissary, rental, service, or opportunity information;
- availability or operating information;
- communications and inquiries;
- listing claim or verification information; and
- other information you choose to provide.
2. Public Listings and Profiles
VendorWheel is designed to help members of the mobile food community find and connect with one another.
Information that you choose to publish in a public listing, profile, opportunity, review, or similar area of VendorWheel may be visible to other users and the general public.
Depending on the listing and your selections, publicly visible information may include business names, descriptions, photographs, general or precise locations, service areas, telephone numbers, websites, social media information, services, availability, reviews, and other listing information.
Do not publish personal or sensitive information that you do not want publicly available.
Public information may also be indexed by search engines or copied by third parties.
3. Information From Public and Third-Party Sources
VendorWheel may create, maintain, or supplement listings using information obtained from publicly available sources and lawful third-party sources.
These sources may include business websites, public directories, social media pages, public records, data providers, mapping sources, and other publicly accessible information.
As a result, a business, property, facility, service provider, or other organization may appear on VendorWheel before its owner or representative creates a VendorWheel account or claims the listing.
The presence of an unclaimed listing does not mean the business has registered with, endorsed, or partnered with VendorWheel.
Eligible businesses may be able to claim listings or request corrections to listing information.
4. Information Collected Automatically
When you access or use VendorWheel, we or service providers supporting the Platform may automatically collect certain technical and usage information.
This may include:
- Internet Protocol (IP) address;
- browser type;
- device type;
- operating system;
- referring website;
- pages viewed;
- links or features used;
- approximate geographic location;
- dates and times of visits;
- session information;
- cookies and similar technologies; and
- diagnostic, security, and performance information.
We may use this information to operate, secure, analyze, troubleshoot, and improve VendorWheel.
5. Location Information
Location information is important to VendorWheel because users may search for food trucks, Wheel Spots, commissaries and commercial kitchens, opportunities, rentals, services, and other resources by geographic area.
VendorWheel may process addresses, service areas, approximate locations, geographic coordinates, or other location information associated with listings or provided by users.
If you allow your browser or device to provide your current location, VendorWheel or a mapping provider may use that information to provide location-based searches or other geographic features.
You can generally control device or browser location permissions through your device or browser settings.
Certain VendorWheel listing types may allow an exact address to be withheld from public display while still using location information to support geographic search functionality.
6. How We Use Information
We may use information to:
- provide and operate VendorWheel;
- create and maintain accounts;
- create, display, and manage listings;
- process listing claims;
- provide verification features;
- provide geographic and search functionality;
- connect users with businesses, locations, opportunities, and service providers;
- facilitate inquiries and communications;
- administer memberships and VendorWheel-provided paid services;
- provide customer support;
- detect and prevent fraud, spam, abuse, and security threats;
- investigate suspected violations of our policies;
- maintain and improve Platform performance;
- understand how users interact with VendorWheel;
- develop new features and services;
- communicate account, service, security, or Platform information;
- send marketing communications where permitted;
- enforce our Terms of Use and other policies;
- establish, exercise, or defend legal claims; and
- comply with applicable legal requirements.
7. Communications Between Users
VendorWheel may provide features that allow users to contact or communicate with businesses or other users.
Information that you voluntarily send to another user will be available to that recipient.
Once information has been provided directly to another user or business, VendorWheel cannot control how that recipient subsequently uses or retains the information.
Use appropriate judgment before providing financial information, identification documents, payment information, or other sensitive information to another user.
8. Payments
VendorWheel may charge fees for VendorWheel-provided services such as memberships, subscriptions, advertising, promotional placement, enhanced listings, verification services, or other features.
Payment transactions for VendorWheel-provided services may be processed by third-party payment providers.
VendorWheel generally does not need to receive or store complete payment-card information when a third-party payment processor handles the transaction.
Payment providers process information according to their own terms and privacy practices.
Payments made directly between users—for example, catering deposits, parking or Wheel Spot fees, commissary fees, rental payments, or payments to independent service providers—are generally transactions between those users and are not controlled by VendorWheel.
9. Cookies and Similar Technologies
VendorWheel and companies that support the Platform may use cookies, pixels, local storage, and similar technologies.
These technologies may be used to:
- operate essential website functions;
- maintain account sessions;
- remember preferences;
- improve performance;
- understand website usage;
- prevent fraud and abuse;
- provide analytics; and
- support advertising or promotional functionality.
You may be able to block or delete cookies through your browser settings.
Disabling certain cookies may prevent portions of VendorWheel from functioning correctly.
10. Analytics and Advertising
VendorWheel may use analytics services to understand Platform traffic, usage, performance, and user interactions.
VendorWheel may also display advertising, sponsored listings, featured businesses, or other promotional content.
Advertising or analytics providers may process device, usage, cookie, or similar information in accordance with applicable law and their respective privacy policies.
If VendorWheel introduces technologies or advertising practices requiring additional disclosures, consent mechanisms, or privacy choices, we will provide those disclosures and controls as required.
11. Mapping and Geolocation Services
VendorWheel may use third-party mapping and geolocation services, including Mapbox, to provide maps, location suggestions, geographic searches, distance-related functionality, and other location features.
Information necessary to provide these functions may be transmitted to or processed by the applicable mapping provider.
Those providers maintain their own privacy practices and policies.
12. How We Disclose Information
VendorWheel may disclose information in the following circumstances.
Service Providers
We may provide information to companies and contractors that help us host, operate, secure, analyze, maintain, communicate, process payments, or otherwise support VendorWheel.
Other Users and the Public
Information you intentionally publish through a public listing, profile, review, opportunity, or similar feature may be available publicly.
Information you intentionally send to another user may be provided to that recipient.
Legal, Security, and Safety Purposes
We may disclose information when we reasonably believe disclosure is necessary to:
- comply with applicable law or legal process;
- respond to lawful governmental requests;
- enforce our agreements and policies;
- investigate suspected fraud or abuse;
- protect VendorWheel’s rights or property;
- protect users or others; or
- maintain the security and integrity of the Platform.
Business Transactions
Information may be disclosed or transferred as part of a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or other business transaction involving VendorWheel.
13. Sale or Sharing of Personal Information
VendorWheel does not sell personal information for money simply because you use the Platform.
Certain privacy laws use terms such as “sale” or “sharing” more broadly and may apply those definitions to some advertising or data practices even when money is not exchanged for personal information.
If VendorWheel engages in activities that constitute a regulated sale or sharing of personal information, we will provide the notices and privacy choices required by applicable law.
14. Public Information and Search Engines
Information displayed publicly on VendorWheel may be accessed by people who are not registered VendorWheel users.
Public information may also be indexed by search engines, cached, archived, copied, or redistributed by third parties.
VendorWheel cannot control information independently retained by third parties after it has been made public.
Please consider this before publishing information.
15. Listing Corrections and Claims
If you believe a VendorWheel listing concerning you or your business contains incorrect information, you may use available listing claim or correction features or contact VendorWheel.
VendorWheel may request reasonable information to verify your identity or your authority to represent a business before granting control of a listing or making certain changes.
16. Data Retention
VendorWheel may retain information for as long as reasonably necessary to:
- provide the Platform;
- maintain accounts and listings;
- maintain legitimate business records;
- comply with legal obligations;
- resolve disputes;
- enforce agreements;
- prevent fraud and abuse;
- maintain security; and
- establish or defend legal claims.
Retention periods may vary depending upon the nature of the information and why it was collected.
Information may remain in backups or archival systems for a limited period after removal from active systems.
17. Data Security
VendorWheel uses reasonable administrative, technical, and organizational safeguards intended to protect information against unauthorized access, loss, misuse, alteration, or disclosure.
However, no website, network, database, or Internet transmission method can be guaranteed to be completely secure.
You are responsible for protecting your account credentials.
Please notify VendorWheel if you believe your account has been accessed without authorization.
18. Your Privacy Choices and Rights
Depending on where you live and applicable law, you may have rights concerning your personal information.
These may include rights to:
- request access to certain personal information;
- request correction of inaccurate information;
- request deletion of eligible information;
- obtain information about certain processing or disclosure activities;
- opt out of certain marketing communications;
- exercise applicable rights concerning certain advertising or data-sharing practices; or
- appeal certain privacy-request decisions where required by law.
VendorWheel will process valid privacy requests in accordance with applicable law.
We may need to verify your identity before fulfilling certain requests.
Where permitted by law, an authorized agent may submit a request on your behalf, subject to appropriate verification.
19. Account and Communication Choices
Users may be able to update certain account and listing information through VendorWheel.
Marketing communications may contain instructions for opting out of future marketing messages.
Even if you opt out of marketing communications, VendorWheel may continue sending communications reasonably necessary for account administration, security, transactions, policy changes, or Platform operation.
20. Children’s Privacy
VendorWheel is intended for adults and businesses participating in or interacting with the mobile food industry.
The Platform is not directed to children under 13, and VendorWheel does not knowingly collect personal information from children under 13.
If we learn that personal information from a child under 13 was collected in violation of applicable law, we will take appropriate steps to delete it.
21. Third-Party Websites and Services
VendorWheel listings and other Platform content may contain links to websites, social media accounts, payment services, maps, or other services operated by third parties.
VendorWheel does not control those third parties or their privacy practices.
Your interaction with a third-party service is governed by that provider’s applicable terms and privacy policies.
22. Changes to This Privacy Policy
VendorWheel may update this Privacy Policy as the Platform, technology, business practices, or legal requirements change.
When we update this Privacy Policy, we will revise the Last Updated date above.
We may provide additional notice or request renewed consent when required by applicable law.
